PREAMBLE. CONDITIONS OF CURRENT OFFERS

1. PURPOSE

These general terms and conditions of sale (GTC) aim to define the rights and obligations of the company BALIBARIS and its Users and Customers on the website www.balibaris.com (hereinafter "the Site"). They apply exclusively between BALIBARIS, SAS with capital of €365,694.28 registered under the unique number 527 995 278 RCS, whose registered office is located at 35 rue de Sèvres, 75006 Paris, France (hereinafter "BALIBARIS") and any individual consumer visiting or making a purchase via said Site (hereinafter "the Customer").

On the Site, BALIBARIS allows the Customer to order BALIBARIS brand products online (hereinafter "the Product(s)") in accordance with these general terms and conditions. Any order placed with BALIBARIS therefore entails the Customer's unreserved acceptance of these terms and conditions. These general terms and conditions may be modified at any time and without notice by BALIBARIS, the applicable conditions being those in force on the date of the order by the Customer.

These general terms and conditions of sale are permanently accessible at the following address: https://www.balibaris.com/pages/conditions-generales-de-ventes in a computer format allowing them to be printed and/or downloaded, so that the Customer can reproduce or save them.

2. PRODUCTS AND CONFORMITY

The Products offered for sale are presented on the BALIBARIS website and accompanied by the most complete product description possible.

The Products offered by BALIBARIS comply with the standards applicable in France.

Elements such as photographs, texts, graphics as well as all information and characteristics illustrating and/or accompanying the Products are not contractual, which the Customer acknowledges.

Consequently, BALIBARIS cannot incur any liability in the event of an error or omission in any of these elements or in the event of modification of said elements by the suppliers and/or publishers.

3. CUSTOMER OBLIGATIONS

Any individual can create their customer account on the page "Identification > Create my account ( https://www.balibaris.com/account/login )". To create their account, the customer must fill out the form in this section of the site.

This account is strictly personal and allows you to identify yourself before each order. When creating the customer account, the Customer declares that they are at least 18 years old and have the legal capacity or hold parental authorization allowing them to place an order on the Site. The Customer also undertakes to provide BALIBARIS with the real and necessary information for the performance of the service covered by these conditions as requested online and according to their situation, in particular their last name, first name, address, telephone number and valid email.

The Client is responsible for the consequences arising from information transmitted that is false or inaccurate or whose use is unlawful.

When creating an account, the customer provides a personal and confidential email address and password. If the customer suspects fraudulent use of their account by a third party, they must promptly notify BALIBARIS to change their password and close their customer account.

The Customer can modify their data via the “My Account” section at any time.

BALIBARIS may close an account and delete all personal data associated with that account if a customer expressly requests this by email to service-client@balibaris.com.

4. ORDER

Any order will only be validated after acceptance of payment.

BALIBARIS reserves the right to cancel or refuse an order in the event of a dispute with the Customer over a previous order.BALIBARIS may accept orders within the limits of available stocks. It informs the Customer of the availability of the Products sold on the Site at the time of order confirmation.

If, despite BALIBARIS's vigilance, Products are unavailable, BALIBARIS will inform the Customer by email as soon as possible and will refund the missing item(s). The remainder of the order will be shipped according to the procedure defined below.

Permanent or temporary unavailability shall not in any case engage the responsibility of BALIBARIS, nor shall it give rise to any right to compensation or damages in favor of the Client.

5. PRICE

The prices displayed on the French Site are indicated in euros including all taxes (French VAT and other taxes that may be applicable), excluding shipping costs.

Shipping costs will be indicated in the Customer's basket, before final validation of the order.

Prices may be modified at any time, without notice, particularly in the event of changes in tax or economic data. Items will be invoiced based on the rates in effect at the time the order is placed

6. DELIVERY

BALIBARIS delivers its products to mainland France, including Corsica, Europe, and countries outside the European Union.

The products are shipped with the delivery slip, to the delivery address indicated by the Customer when ordering. Delivery cannot be made to hotels or PO boxes. The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times, they are to be calculated in working days. In order for these deadlines to be respected, the Customer must ensure that they have provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

In the event of a delivery delay of more than 7 working days, if the product has not been shipped, the Customer may cancel the order by email and request a refund.

If the item has been shipped before receipt of the cancellation of the order due to a shipping delay of more than 7 days, BALIBARIS will refund the item and the shipping and return costs, upon receipt of the item, complete, in its original condition and with all labels.

BALIBARIS undertakes to inform the Customer of the progress of the processing of his order.

When Balibaris delivers the Product, the risk of loss or damage is transferred to the Customer upon receipt of the package. It is the Customer's responsibility to immediately check, upon delivery, that the Products comply with their order. Any anomalies noted (damaged package, missing or damaged Product, etc.) must be noted on the delivery slip in the form of handwritten reservations, accompanied by their signature.

In the event of damage noted after opening the package, the Customer undertakes to notify BALIBARIS of any reservations within 48 hours of receiving the product.

For any order delivered outside the European Union:

- All prices displayed on our site include the value added tax (VAT) applicable in France.

- Balibaris undertakes to pay all taxes due on the importation of products, customs duties, value added tax and all other taxes due under the laws of the country where the order is received

7. PAYMENT

7.1. Accepted payment methods

The following payment methods are accepted: credit card (Visa, Mastercard and American Express), Paypal, gift cards and credit notes, payment in installments with Alma (on balibaris.com only).

7.2. Security of payment methods

The payment solutions adopted by BALIBARIS are 100% secure.

For credit card payments (Visa, Mastercard, and American Express), Stripe handles payment security. All information provided by customers to BALIBARIS is strictly protected, ensuring the compliance and security of each transaction.

For PayPal payments, PayPal is responsible for securing payments. All information provided by customers to BALIBARIS is strictly protected, ensuring the compliance and security of each transaction.

For installment payments, Alma handles payment security. All information provided by customers to BALIBARIS is strictly protected, ensuring the compliance and security of each transaction.

7.3. Conditions of immediate payments

Except for payment in installments, the full payment must be made at the time of ordering. At no time may the amounts paid be considered as a deposit or down payment. The Customer pays for their order by credit card (Visa, Eurocard/Mastercard) in accordance with the provisions of this article or via PayPal.

For any transaction, the Customer will indicate the number on the front of his card, the expiry date of his card and the cryptogram on the back of his card (last three digits).

The communication by the Customer of his bank card number constitutes authorization for BALIBARIS to debit his account up to the amount of his order.

No cash on delivery shipments will be accepted, whatever the reason.

BALIBARIS retains ownership of the item until full payment of the price by the Customer.

7.4. Conditions for payments in installments

Payments in installments with Alma on the BALIBARIS website are authorized from 100 euros for payments in 2 and 3 installments and from 200€ for payments in 4 installments and up to 2000 euros on balibaris.com only for holders of Belgian and French bank cards.

If you pay for your order in installments, you accept Alma's general customer conditions as well as Alma's specific conditions for Balibaris customers.

The communication by the Customer of his bank card number and the validation of the payment constitutes authorization for Alma to debit his account up to the amount of his order on the due dates defined during the payment process.

A customer wishing to return an order paid in installments with Alma will be reimbursed for their return upon receipt and verification by our warehouse according to the following terms:

If the customer returns only part of their order, the fees associated with paying in installments with Alma will not be refunded. Depending on the remaining installments and the amount of the returned items, Alma will debit or credit the credit card used for payment.

If the customer returns their entire order, the fees associated with the installment payment with Alma will be fully refunded. Depending on the remaining installments and the amount of the returned items, Alma will debit or credit the credit card used for payment.

8. ASSETS

8.1. Payment with credits on the site

Credits can be used on the website by entering the credit code in the "Discount Codes" field on the payment page. It is not possible to enter one or more codes on the same order. A credit can be used only once and the total amount of the credit is not divisible. If the total amount of the order exceeds the amount of the credit, the remainder will be payable using the payment methods offered on the website (credit card or Paypal). If the total amount of the order is less than the amount of the credit, the customer will not have to make an additional payment but the remaining amount on the credit will be lost.

8.2. Reimbursement of an order paid in full or in part with a credit note

If the order was paid in full with a credit note:

Balibaris will issue a new credit note for the amount of the returned items, subject to validation of the return upon receipt by our warehouse. This credit note will be valid for a new 6 months, unless the original credit note has already expired by the date the return credit note is issued. In this case, the validity period of this new credit note is 1 month. This credit note can only be used on the Balibaris website.

If the order was paid partly with a credit note and partly with an additional payment method:

- Part paid with a credit note: Balibaris will refund the portion of the items paid for with the credit note by issuing a new credit note for the amount equal to this portion of the order paid for with the credit note, subject to validation of the return upon receipt by our warehouse. This credit note will have a new validity of 6 months, except in the case where the original credit note has already expired on the date of issue of the return credit note. In this case, the validity period of this new credit note is 1 month. This credit note can only be used on the Balibaris website.

- Part paid with an additional payment method: Balibaris reimburses the part of the items paid for with an additional payment method (bank card or Paypal) on the same payment method, subject to validation of the return upon receipt by our warehouse.

9. E-GIFT CARD

9.1. Purchase of e-gift cards on the site

E-gift cards are available for purchase on the website. These cards are valid only on the website www.balibaris.com for a period of one year from the activation date. Gift cards purchased in-store cannot be used online.

9.2. Payment with gift cards on the site

E-gift cards can be used on the website by entering the gift card code provided in the confirmation email for the gift card purchased on the website or provided by one of our partners in the "Discount Codes" field on the payment page. E-gift cards cannot be combined with each other or with other promotional codes or credits.

If the total amount of the order exceeds the amount of the gift card, the remaining amount will be payable using an additional payment method (credit card or PayPal). If the total amount of the order is less than the amount of the gift card, the customer will not have to make an additional payment and the remaining amount of the gift card will be usable on their next purchase on the website. If the gift card is not used in its entirety during the first order, the validity date of the gift card remains unchanged.

9.3. Refund of an order paid in full or in part with an e-gift card

If the order was paid in full with an e-gift card:

Balibaris will refund the used e-gift card. This e-gift card can only be used on the Balibaris website.

If the order was paid for partly with an e-gift card and partly with an additional payment method:

- Portion paid with an e-gift card: Balibaris will refund the portion of items paid for with an e-gift card by re-crediting the e-gift card used. This e-gift card can only be used on the Balibaris website.

- Part paid with an additional payment method: Balibaris reimburses the part of the items paid for with an additional payment method (bank card or Paypal) on the same payment method, subject to validation of the return upon receipt by our warehouse.

10. RETURNS OF PRODUCT(S) RIGHT OF WITHDRAWAL

Right of withdrawal

In accordance with article L.221-18 of the Consumer Code, the Customer has a period of fourteen (14) days from receipt of the web order to exercise his right of withdrawal from Balibaris, without having to justify his decision.

If it is a delivery to a store or relay point (click and collect or Mondial Relay), the order delivery date retained is that of the arrival of the product in the store or relay point and not that of its receipt by the customer.

If the item is not returned by the Customer within fourteen (14) days of receipt of the order, the return is considered cancelled and the sale is considered firm and final.

The customer can exercise his right of withdrawal by logging into his customer account in the “order” section then completing the return form, or by using the following link .

The Customer may not exercise their right of withdrawal for a Product made to their specifications, used, worn, washed, damaged or unsealed. If the Customer fails to comply with these conditions, in particular the return conditions, BALIBARIS will not be able to refund the Products concerned.

Return terms and conditions

From mainland France, returns are free of charge and can be made by post or directly in one of our stores.

For returns by post:

Once the Customer has made a return request, BALIBARIS will send the Customer a prepaid postage label by email to cover the shipping costs for all orders in mainland France.

The return is at the Customer's risk. The Product must be returned within fourteen (14) days in its original packaging, in its original condition, new, unworn, unwashed, labelled and accompanied by the return slip.

For store returns, only the following stores are eligible to accept returns:

Balibaris - Paris La Défense Quatre Temps

The Product must be returned within fourteen (14) days in its original packaging, in its original condition, new, unworn, unwashed, labelled and accompanied by the return slip.

For returns outside France, returns are at the customer's expense: Once the Customer has made the return request, BALIBARIS will send the customer a prepaid postage label by email. The customer is responsible for the shipping costs, which will be deducted from their refund.

The Customer must also enclose the original invoice for the order in question to prove that it is the same item. If these instructions are not followed, Balibaris will not be able to accept the return parcel and will not be able to refund the order. It is not possible to return a product purchased on the website to a store, or vice versa.

The returned Product will be refunded within a maximum of fourteen (14) days from its receipt by BALIBARIS, by crediting the amount to be refunded to the payment method used when the order was confirmed.

Lifetime warranty

The products covered by the Lifetime Guarantee are: Andrew Parka, Floyd Parka, Paolo Leather, Smith Raincoat, Hanks Shorts, Charles Chinos and Paul Chinos. All other references are excluded from the Lifetime Guarantee. For all the products listed above, only the following cases are covered by the Lifetime Guarantee: broken zip, unstitched seams, holed lining (trouser pockets, inside of jacket/coat) and detached snaps. The Lifetime Guarantee only applies to eligible items purchased between 01/10/2022 and 31/12/2024, subject to presentation of proof of purchase. Acceptable proof of purchase is the receipt for in-store purchases or the invoice for online orders.

*Extended returns : Returns and exchanges are accepted until January 15, 2026 for all web orders placed between November 19, 2025 and January 1, 2026.

11. WARRANTIES AND LIABILITY

BALIBARIS has, for all stages of access to the site, from the ordering process to the shipment of the package or subsequent services, only an obligation of means. BALIBARIS cannot be held liable for any inconvenience or damage inherent to the use of the internet network, in particular a service interruption, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with the law and case law.

12. INTELLECTUAL PROPERTY

Under no circumstances is the Customer authorized to download or modify all or part of the Site and in particular its content (listed products, descriptions, images, videos, etc.).

This Site or any portion of this Site may not be reproduced, copied, sold or exploited for any commercial purpose without the express written permission of BALIBARIS.

Generally speaking, all copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the Site will remain the full and entire property of BALIBARIS.

The Customer is therefore required to respect intellectual property rights and may not use the trademarks appearing on the Site and on the Products where applicable, or register a trademark which would be prejudicial to the rights holder, unless otherwise provided in the contract.

The same applies to any other intellectual property right.

13. PRIVACY POLICY & PERSONAL DATA PROTECTION

Under the European Data Protection Law, BALIBARIS must control its Customers' data from the balibaris.com website.

Personal data may be collected on the Site and used by BALIBARIS, which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter “General Data Protection Regulation” or “GDPR”).

BALIBARIS is required to ensure the security and confidentiality of its Customers' personal data in accordance with the GDPR. Customers' personal data may be transmitted to BALIBARIS service providers and partners, in the event that their intervention is necessary in the processing and management of orders (last name, first name, postal address, telephone number, email address). These service providers and partners may only act on instructions from BALIBARIS.

The purposes of the personal data collected are detailed below:

Processing Customer orders (shipping, returns, refunds)

Data relating to an order entered during payment will be transmitted to our banking service provider for validation of this payment.

If the Customer has checked the box to subscribe to the BALIBARIS Newsletter, he expresses his consent to receive marketing communications from the brand.

In accordance with the GDPR law, the Client has the right to access, rectify and oppose personal data concerning him/her (hereinafter the “Data Protection Rights”).

In accordance with data protection law, the Client is entitled to:

- Request a copy of all information held about him.

- Request a rectification of your personal data.

- Request complete deletion of your account and personal data.

To exercise this right, the Customer must submit a request by email to: service-client@balibaris.com, via the contact form, or by mail to: BALIBARIS, 35 rue de Sèvres, 75006 Paris, FRANCE, stating their first and last name, email address, and customer references. The Customer's request must be signed and accompanied by a photocopy of an identity document.

In accordance with the “Information Technology and Freedoms” law, the response will be provided as soon as possible and at the latest within one month following the request.

Retention of your data:

The Data is kept for a period that does not exceed the period necessary for the purposes for which it was collected.

Information Commissioner:

The President, Paul Szczerba, is the decision-making authority of BALIBARIS SAS and can provide you with further information regarding your rights and obligations regarding your personal data. He will also be the contact person for handling any queries you may have regarding your personal data.

14. COMMERCIAL OFFERS AND NEWSLETTERS

BALIBARIS may send its Customers marketing information related to the brand by mail, email, text message, telephone, subject to prior consent.

The Customer may at any time object to these marketing mailings by clicking on the “unsubscribe” link at the end of marketing emails, by making a request by email to service-client@balibaris.com, by post, or by replying STOP by SMS (within 3 days of receiving a Balibaris SMS campaign).

15. COOKIES

The “COOKIE” section aims to define the term “COOKIE”, its use by BALIBARIS and the means enabling visitors to the Site to manage these Cookies.

A "COOKIE" is an alphanumeric file used by most websites to improve the user experience and facilitate navigation on the Site. This "COOKIE" file is placed on the user's terminal (computer, mobile, tablet) by the BALIBARIS site server in this case. The purpose of issuing a "COOKIE" by the BALIBARIS server is to remember the user whether during the current visit: "session cookie" or during a future visit "persistent cookie", for the duration of its validity.

These are “COOKIES” that allow us to remember the choices made by Customers on the Site, such as the language chosen, geographic location, and type of terminal used.

Advertising “COOKIES” or targeting “COOKIES”:

These are "COOKIES" used to deliver marketing advertisements based on information collected about your browsing habits on the Site. They allow sites with advertising spaces to display advertisements that may be of interest to you. These advertising spaces contain "COOKIES" which are intended to measure the effectiveness of marketing campaigns, as well as to limit the number of advertisements displayed to you each day. The issuance of "COOKIES" by third parties is subject to the privacy policies specific to these third parties.

16. FORCE MAJEURE

In the event of the occurrence of a force majeure event, the party concerned must inform the other within fifteen (15) days of the occurrence of this event, by registered letter with acknowledgment of receipt.

Expressly, the following are considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the jurisprudence of French courts and tribunals: total or partial strikes, lockouts, riots, boycotts or other actions of an industrial nature or commercial disputes, civil unrest, insurrection, war, bad weather, epidemics, blockages of means of transport or supply for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes to forms of marketing, computer breakdowns, blockages of telecommunications, including wired or wireless telecommunications networks, and any other case beyond the control of the parties preventing the normal execution of the contractual relationship.

All obligations of the parties will be suspended for the duration of the force majeure event, without compensation.

If the force majeure event continues for more than three (3) months, the contract concerned may be terminated automatically without compensation for either party.

17. GENERAL PROVISIONS

1. Partial invalidity of a clause

If any of the provisions of these conditions is declared null or unenforceable by a competent court, it will be declared unwritten and will not result in the nullity of the other provisions.

2. Update

These general conditions may be modified at any time and without notice by BALIBARIS, the applicable conditions being those in force on the date of the order by the Customer.

3. Applicable law – Competent court

These general terms and conditions are subject to French law with regard to both substantive and procedural rules. Any dispute must be subject to a prior attempt at amicable settlement.

In the event of a dispute arising from an order in accordance with these General Terms and Conditions, the Customer must address their complaints in writing to Balibaris, by email to contact@balibaris.com or by post to Balibaris's head office. The reasons for the complaint must be specified and fully justified in writing.

If the dispute is not resolved after this complaint, the Customer has the option of opting for an alternative dispute resolution method. The Customer has the right to use a consumer mediator free of charge (excluding any lawyer and expert fees) with a view to an amicable resolution of the dispute between them and Balibaris. However, certain conditions must be met: (i) the Customer must have previously attempted to resolve the dispute directly with Balibaris by submitting a written complaint as indicated above, (ii) the Customer's request must not be unfounded, and (iii) the dispute must not have been examined by another mediator or a court. The Customer has one year from their written complaint to Balibaris to submit their request to the mediator.

The Client may submit their request by mail to the Consumer Mediation Center of Conciliateurs de Justice, at the following address: CM2C - 14 rue Saint Jean - 75017 Paris, France, or by email to contact@cm2c.net. They may also submit their request online at www.cm2c.net. For more information on the mediation procedure, the Client may consult the CM2C website (http://www.cm2c.net).

The Customer also has the option of using the European online dispute resolution platform: http://ec.europa.eu/consumers/odr/.

In the event of a dispute concerning an order or the application of these General Terms and Conditions, the consumer may refer the matter to either one of the courts with territorial jurisdiction in accordance with the Code of Civil Procedure, or to the court of the place where he resided at the time of the conclusion of the contract or the occurrence of the harmful event.

4. : Reproduction of applicable texts (order 2005-136 of February 17, 2005, Consumer Code, Civil Code)

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee is applicable to this digital content or this digital service throughout the period of supply provided. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date on which it appeared.

The legal guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity gives the consumer the right to have the goods repaired or replaced within thirty days of their request, free of charge and without any major inconvenience to them.

If the product is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests the repair of the goods, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund upon return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods takes place after a period of thirty days;

3° The repair or replacement of the good causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of recovery or removal of the non-compliant good, or if he bears the costs of installation of the repaired or replacement good;

4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the good or to the termination of the contract when the lack of conformity is so serious that it justifies an immediate reduction in the price or termination of the contract. The consumer is then not required to request the repair or replacement of the good beforehand.

The consumer is not entitled to cancel the sale if the lack of conformity is minor.

Any period of immobilization of the property for the purpose of repair or replacement suspends the warranty which remained to run until delivery of the repaired property.

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the consumer code.

A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the item is kept or to a full refund upon return of the item.

In accordance with Article L223-2 of the Consumer Code: The Customer is informed that he/she has the possibility of registering on the telephone canvassing opposition list at the address http://www.bloctel.gouv.fr/.

18. E-RESERVATION

The SoCloz e-reservation service allows the User to reserve items free of charge in the Store at www.balibaris.com

Two hours later, the item will be available in the Balibaris Store chosen by the User when making their reservation request, if and only if the Store validates the availability of the item.

The prices indicated for each product are those in effect on the Site.

In the case of an exclusive web offer, this will not apply to the price of the e-reservation, which remains a Boutique purchase and not a web order. In the case of a limited-time Boutique offer, the e-reservation does not allow the offer to be extended. The User must go to the Boutique to collect their reservation before the end of the promotion to take advantage of it.

The principle of e-reservation is as follows:

- The User reserves for free in one click on the website www.balibaris.com, on the product sheet. To do this, the User clicks on "reserve in stores", chooses the color, the size and the Store in which he wishes to e-reserve the item.

- The e-reservation will be validated within two hours. A confirmation is sent by email and SMS to the User, and their product will be waiting for them in the Store for 24 hours.

- After this period, the reservation will be automatically cancelled and the product will be put back on sale.

*During periods of high commercial activity (such as sales, private sales), the response time may be extended to 3 hours.

Reservation procedure

For each product, the service is available in all Stores offering the service that have a stock of merchandise allowing e-reservations to be made. Once the User has selected their product and their collection Store, the Site requests the User's email address, name, and telephone number to be contacted by the Store.

The User then receives from the Store he has selected:

- an email acknowledging receipt of the reservation indicating that the request has been forwarded to the Boutique,

- an email and an SMS informing you that the goods are available and the collection deadline.

If the User does not collect the reserved product before the collection deadline, their reservation will be automatically canceled. The products will be put back on sale and will therefore no longer be available to the customer who has exceeded the 24-hour collection deadline.

The User is only billed when paying for the item in the Store.

Product availability

Our product and price offers are valid for as long as they are visible on the Site and within the limits of available stocks, except for special operations whose validity period is specified on the Site.

The User is invited to check the availability of the items sold on the information page of each product. The availability of the products reflects the stocks of the store selected by the User, at the time the User consults it. However, it is understood that this availability is given for information purposes only, the products may be sold between the time of the reservation by the User and the validation of this e-reservation by the Store.

In the event that a reserved product is unavailable, the Store will then inform the User of this unavailability and therefore of the cancellation of the reservation.

If the User wishes, they may also opt to cancel their reservation, provided they first inform the Store in charge of the reservation (via the link provided in their confirmation email). In all cases, a cancellation email will be sent to the User to confirm the cancellation of the order.

Payment

Reserving the product in the Store selected by the User does not imply online payment by the User. Payment will be made in the Store, upon collection of the goods, by any payment method in force in the Store.

Informative subtitle General Terms and Conditions specific to e-reservations

The general conditions of sale applicable to e-reservations are those of the Boutiques or Corners.

For any purchase in Boutiques or Corners, the User must refer to the commercial policies of the Boutiques or Corners.

19. MODIFICATIONS TO THE GTC

BALIBARIS reserves the right to modify the T&Cs at any time.
